Terms of service

Last updated: October 22, 2026

These terms apply to the Modus desktop application and to this website, offered by Luis Varela, an individual based in Chile (“we”, “us”). By installing or using Modus you agree to them. If you do not agree, do not use Modus.

1. The software

Modus is offered free of charge. We grant you a personal, non-exclusive, non-transferable licence to install and use Modus, for personal or professional work, on computers you own or control. You may not sell, resell or redistribute Modus, or remove its notices. Pre-release (beta) builds may stop working on a stated date.

2. Your accounts and third-party services

Modus works with services you choose to connect — Google, Jira, GitHub, Bitbucket — and with AI coding agents you install and sign in to yourself, such as Claude Code or Kiro CLI. Your use of those services is governed by their own terms, and any cost they charge (for example, AI usage) is yours. You are responsible for having the right to use the repositories, cards and data you connect, including your employer’s.

3. What agents do

AI agents can be wrong. They can write incorrect code, run commands and change files in your repositories. Modus asks for your approval before shell commands you have not allowed and before acts that change your setup, but you remain responsible for reviewing, committing, pushing and merging any change, and for what you approve.

4. Acceptable use

Do not use Modus to break the law, to infringe others’ rights, or to attack or overload the services it connects to.

5. No warranty

Modus is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not guarantee that Modus will be error-free, secure or uninterrupted, or that it will not lose data. Keep your work under version control and backed up.

6. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost data, profits or work, arising from your use of Modus or of the services and agents it runs — even if we were told such damage was possible. Since Modus is free, our total liability for any claim is limited to zero, or to the minimum amount the applicable law requires. Nothing in these terms limits rights that consumer law gives you and that cannot be waived.

7. Privacy

How Modus handles data is described in the privacy policy.

8. Changes and ending

We may update Modus and these terms; the new terms will be published here with a new date, and continuing to use Modus after that means you accept them. You can stop using Modus at any time by uninstalling it. We may stop offering Modus at any time.

9. Law

These terms are governed by the laws of Chile. Any dispute will be resolved by the competent courts of Santiago, Chile, unless the law of your country gives you the right to go to your own courts.
